Terms of Use

Ponto Structural, Inc.    |    Effective Date: 9/8/2026

These Terms of Use (the “Terms”) govern your access to and use of the website at [pontoinc.com] (the “Site”), which is operated by Ponto Structural, Inc. (“Ponto,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. About Ponto Structural, Inc.

Ponto Structural, Inc. is a structural engineering firm located at 2251 Paseo Saucedal, Carlsbad, California 92009. Professional engineering services are provided by or under the responsible charge of engineers licensed in the applicable jurisdiction. [Dominic Lucido - California Professional Engineer License Number C89088]

2. No Engineering Advice; No Professional Relationship

The content on this Site is provided for general informational and marketing purposes only. It is not engineering advice, it is not a professional opinion, and it is not a substitute for engagement of a licensed engineer for your specific project.

Structural engineering depends on project-specific conditions — loads, geometry, site and subsurface conditions, materials, existing construction, and the codes and amendments in effect in a particular jurisdiction at a particular time. Nothing shown or described on the Site accounts for the conditions of your project.

Your use of the Site does not create a client, engineer-client, or other professional relationship between you and Ponto. No such relationship is formed unless and until Ponto and you have executed a written agreement for professional services. Submitting an inquiry through the Site, subscribing to our mailing list, or corresponding with us does not create such a relationship and does not obligate Ponto to perform any services.

Do not act, or refrain from acting, in reliance on anything appearing on the Site. Retain a qualified licensed professional for your project.

3. No Reliance on Site Content

We make reasonable efforts to keep the Site accurate and current, but content may become outdated, and codes, standards, and practices change. We do not warrant that Site content is accurate, complete, or current, and we assume no obligation to update it. Any details, images, diagrams, or descriptions of methods or systems appearing on the Site are illustrative only and are not construction documents, are not sealed, and may not be used for construction or permitting.

4. Project Descriptions and Images

Projects described or depicted on the Site are shown to illustrate the type and scope of work Ponto performs. Depictions are illustrative and may be partial, simplified, or modified. Ponto's role on any depicted project was limited to the structural engineering services it was engaged to perform, and reference to a project does not represent that Ponto performed architectural, geotechnical, civil, construction, or other services, or that Ponto is responsible for the design or construction of the project as a whole.

Photographs and renderings may be the property of the project owner, architect, photographer, or another party and are used with permission. If you believe an image or project reference on the Site should be removed, contact us at the address in Section 13 and we will address it promptly.

5. Intellectual Property

The Site and its contents — including text, graphics, drawings, details, diagrams, photographs, layout, design, and the Ponto Structural, Inc. name and logo — are owned by Ponto or its licensors and are protected by copyright, trademark, and other laws.

You may view the Site and print or download individual pages for your own internal, non-commercial reference. You may not otherwise copy, reproduce, republish, distribute, modify, create derivative works from, or use any Site content for commercial purposes, and you may not use any drawing, detail, or diagram appearing on the Site in connection with any project, without Ponto's prior written consent.

Any drawings, calculations, specifications, reports, or other documents that Ponto prepares for a client remain Ponto's instruments of service and are governed by the written agreement with that client, not by these Terms.

6. Acceptable Use

  • Use the Site for any unlawful purpose or in violation of these Terms

  • Attempt to gain unauthorized access to the Site, its servers, or any connected system

  • Introduce malware, or interfere with or disrupt the Site or its infrastructure

The Site may contain links to third-party websites. Those links are provided for convenience only. We do not control, endorse, or assume responsibility for the content, products, services, or practices of any third-party site.

9. Disclaimer of Warranties

THE SITE AND ALL CONTENT ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. PONTO SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. PONTO DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PONTO AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND SUBCONSULTANTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO USE, THE SITE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, AND WHETHER OR NOT PONTO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF PONTO ARISING OUT OF OR RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Ponto and its directors, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

12. Relationship to Written Agreements

If you have entered into a written agreement with Ponto for professional services, that agreement governs that engagement and controls over these Terms to the extent of any conflict. These Terms apply to your use of the Site only and do not modify, supplement, or limit the terms of any professional services agreement.

13. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. The exclusive venue for any dispute arising out of or relating to these Terms or the Site shall be the state or federal courts located in San Diego County, California, and you consent to personal jurisdiction in those courts.

14. Changes to the Site and to These Terms

We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also revise these Terms from time to time. The revised version will be posted on this page with a new Effective Date, and your continued use of the Site after that date constitutes acceptance of the revised Terms.

15. General

If any provision of these Terms is held invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed, and the remaining provisions shall remain in full force and effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Ponto regarding the Site.
